These General Conditions clarify the interaction between the User and the Foundation’s website during navigation or the use of the functionalities made available to the visitor.

1.1 These general terms establish the conditions under which it is permitted to use the site www.CreasysYouthFoundation.org (hereinafter referred to as the “Site”) by anyone (referred to as the User: hereinafter “User” or “Users”) who accesses it.
1.2 “Use” of the Site refers to accessing and browsing within it by Users, who must adhere to these terms by complying with them.
1.3 The owner of the Site (hereinafter referred to as the “Owner”) is the Creasys Youth Foundation, based in Rome (RM), Piazza Albania, no. 10, PEC address: creasysyouthfoundation@pec.it; ordinary email address: info@creasysyouthfoundation.org.
1.4 The following additional provisions apply to these terms, given the particular characteristics of the Site:
2.1 The Site is made available free of charge.
2.2 The Owner reserves the right to suspend, delete, interrupt, or modify, in whole or in part, the Site without prior notice and will not be held liable to Users if, for any reason, the Site becomes unavailable, in whole or in part.
2.3 Access to certain services on the Site is reserved for Users who are of legal age.
3.1 Users must use the Site in strict compliance with these general terms.
3.2 It is the User’s responsibility to review these terms and check for any changes made in accordance with the provisions that follow.
3.3 The User may not use the Site and its related services for illegal purposes, in violation of these terms, or in any way that could damage its functionality, rendering it inoperable. Consequently, the User will be responsible for such conduct and must compensate for any damage incurred by the Owner.
3.4 If the User uses the forms available on the Site, they have the obligation and responsibility to provide truthful, accurate, verifiable, and up-to-date personal data.
3.5 Any behavior that may lead to, even through mere attempts, unauthorized access to the Site and restricted areas is prohibited.
4.1 The User uses the Site “as is,” meaning as it is offered and available at the time the User connects and views its content.
4.2 The Owner is not liable, either to the User or to parties directly or indirectly connected to the User, for damages, claims, and/or losses arising from service disruptions and/or suspensions of the Site caused by the User, third parties, or, in any case, by force majeure and/or unforeseen events.
4.3 The Owner is also not responsible for the information and indications contained on the Site’s pages. In particular, some pages may contain information regarding future programs and plans, which are described from time to time using terms such as “expect,” “estimate,” “foresee,” “envision,” and “schedule.” These statements, by their nature, do not imply any commitment on the part of the Owner, who therefore does not assume any obligations or, consequently, any liability in this regard.
4.4 The Owner is also not responsible for omissions and/or errors that may be contained in the materials and information available on the Site via hyperlinks (links).
5.1 The Site and its contents are the property of the Owner and/or its successors or assigns and/or third parties where indicated, and are protected by the applicable laws concerning the protection of intellectual and industrial property rights. In particular, the Creasys Youth Foundation logos and any other trademark or service name on the Site are registered trademarks of Creasys Youth Foundation and its suppliers or licensors, and may not be copied, imitated, or used, in whole or in part, without the prior written consent of Creasys Youth Foundation or the respective trademark holder.
5.2 Unless otherwise stated, all materials available on the Site (such as, for example, but not limited to, news, photos, videos, sounds, trademarks, logos, domain names, application software, graphic layouts, technical documentation, and manuals, etc.) may only be used by the User for informational and/or personal purposes; any other use must be authorized by the Owner.
5.3 Reproduction of the graphics and structure of the Site, in whole or in part, in such a way that could cause confusion, even through association, with the Site, is prohibited. Therefore, the elements constituting the Site cannot be copied and/or imitated. Consequently, the User: (i) may not use any metatag or other hidden text on the web page using the name/logo “CYF” or any other name, registered trademark, or service name of Creasys Youth Foundation without its prior written consent; (ii) may not copy, imitate, or use, in whole or in part, the image of the Site, the customized graphics, button icons, and scripts representing the trademark of Creasys Youth Foundation without its prior written consent.
5.4 No rights are granted to the User concerning elements or contents protected as intellectual or industrial property that make up the Site or allow its operation, including any computer programs and related updates, and their source codes. Therefore, the User is prohibited from engaging in activities referred to in Article 64-bis of Law 633/41, such as, for example but not limited to: extraction, decompilation, reproduction, translation, adaptation, and distribution to the public, in any form, of the aforementioned elements or contents.
5.5 All rights not expressly granted are reserved.
6.1 If a User believes that some of the materials on the Site infringe their rights, they must send a note to the Owner (so that appropriate checks can be made and any necessary actions taken) containing the following information:
6.1.1 Identification of the violated right or, in case of multiple violations, a list of all the violations detected, accompanied by a statement that the use of the material has not been authorized;
6.1.2 Identification of the material on the Site that violates the aforementioned rights and that is requested for removal or disabling;
6.1.3 Indication of the User’s identification details (including address, phone number, and, if available, email address, including certified email);
6.1.4 A declaration in lieu of affidavit pursuant to Articles 46 and 47 of Presidential Decree 445/2000 stating that the use of the material in question has not been authorized.
6.2 The note referred to in the previous article must be sent, duly signed (including with a digital signature in the case of electronic transmission), via PEC to the address info@creasysyouthfoundation.org or alternatively by registered mail to the following address:

6.3 The User has the right to create a textual hyperlink to the Site for non-commercial purposes, provided that the link does not represent Creasys Youth Foundation or any of its products and services in a false, misleading, or otherwise defamatory manner, and provided that the originating site does not contain any pornographic or, in general, illegal, offensive, or harassing material and does not violate the intellectual property rights referred to in Article 5 above.
6.4 The Owner may, at any time, limit the right granted to the User under Article 6.3 above.
6.5 Users can create their own personal account in the dedicated section of the site, and within it, they can upload videos, graphics, radio ads, banner ads, scripts, concepts, photographs, artwork, and other material or content in order to participate in various initiatives proposed by Creasys Youth Foundation through the site, and these will be processed in accordance with the Privacy Policy.
6.6 In creating and managing their own account, Users are required to:
7.1 The Site allows participation, posting, and transmission of content (audio, video, images, etc.) by the User, who is solely responsible and, therefore, agrees to indemnify and hold harmless Creasys Youth Foundation, its parent companies, subsidiaries, affiliates, independent contractors, service providers, consultants, and their respective directors, employees, and agents, from and against any claim for compensation, damage, cost, liability, or expense arising therefrom in any way.
7.2 Posting and transmission of content is prohibited if it:
7.3 Creasys Youth Foundation is not responsible for any statement or content provided by Users in violation of the provisions above and reserves the right, at its sole discretion, (i) to monitor, remove, refuse, disable access to, monitor, or modify any content posted on the Site at any time and for any reason, without notice; (ii) to take any action to protect the Site and its related policies.
7.4 Unless the content uploaded to the Site is prohibited under the provisions above, Creasys Youth Foundation, from the moment of uploading, acquires a perpetual, irrevocable, worldwide license for the content, including the right (i) to perform editorial revisions, use it, and publish it in any manner or form, including electronic form; (ii) to use it for internal commercial, marketing, and/or advertising purposes; (iii) to license it to third parties for any reason.
8.1 All personal data of the Users are processed by the Owner in compliance with the applicable privacy regulations as further specified in the privacy and cookie policy below, which is also independently accessible through the link at the bottom of the homepage.
9.1 These general conditions are governed by Italian law.
9.2 In case of disputes related to and/or connected with the use of the Site, exclusive jurisdiction is reserved to the Court of Rome, without prejudice to the Consumer Court where provided by law.
10.1 The Owner reserves the right (at its discretion and, in any case, in full compliance with applicable laws and Users’ rights) to make changes to these general conditions at any time; such changes will take effect from the date of their publication on the Site. Users are therefore invited to review these conditions each time they access the Site.
10.2 If any of the provisions of these conditions is declared null or ineffective by the competent authority, the remaining provisions will continue to be fully effective, excluding the affected provision.
